California Assembly Bill 1013 Compliance

What is California AB-1013?

Approved and enacted into California law (adding Section 25624 to the Business and Professions Code), AB-1013 mandates that all holders of an on-sale general license for public premises (Type 48) must offer drug testing devices to their patrons that are capable of detecting common controlled substances such as GHB and Flunitrazepam.

Mandatory Availability

Licensees must have testing devices available at all times. They may be provided free of charge or sold to patrons at a price not to exceed the wholesale acquisition cost.

Required Signage

Venues must display a prominent notice sign in an area clearly visible to patrons (e.g., entrance, bar counter, or restrooms) stating: "Don't let your drink get spiked. Drug test kits available here..."

Statutory Protection

The statute provides that a licensee who in good faith complies with the testing kit and signage mandates is protected by statutory indemnification regarding test results.
